The Constitutional Court held that the Constitution does not identify local self-government with state administration. When a person has by a final decision been convicted of a criminaloffence and when subsequently his conviction has been reversed or he hasbeen pardoned on the ground that a new or newly discovered fact showsconclusively that there has been a miscarriage of justice, the person whohas suffered punishment as a result of such conviction shall be compensatedaccording to law, unless it is proved that the non-disclosure of theunknown fact in time is wholly or partly attributable to him.
Article 36 The Secretary-General of the United Nations shall provide the necessarystaff and facilities for the effective performance of the functions of theCommittee under the present Covenant. ARTICLE VI Supremacy of the Constitution and Federal Laws 1 All debts contracted and Engagements entered into, before the Adoption of this Constitution, shall be as valid against the United States under this Constitution, as under the Confederation.
The Articles of Confederation declared that each state that ratified the document retained its sovereignty and independence and that every power or right not delegated to the United States collectively was retained by the states.
Under the subsequent Constitution, elements of state sovereignty were retained. Under Saddam Hussein, the prison was the site of infamous torturing and execution of political dissidents.
